Have you or a family member or close personal friend been convicted of a crime and been sentenced to a term of imprisonment?

Have you or a family member or close personal friend been convicted of a crime and been sentenced to a term of imprisonment? Have you or your family member or friend expressed dissatisfaction with the way the defense attorney advised you or them? Regardless of whether the case was resolved through a plea or a trial, all convicted defendants are entitled to apply for Post-Conviction Relief to have a determination as to whether their attorney was ineffective in his or her representation on the case that resulted in the conviction and sentence being served. Our attorneys have the experience necessary to evaluate and assist you in these cases. The founding partner of the firm is a former Assistant Attorney General who handled thousands of PCR cases for the state and who has represented dozens of Applicants in their PCR hearings as well as handled their appeals from the hearing court. Forensic & DNA Specific Evidence Consulting

Modern science has made huge advances in forensic sciences in the last several decades. As a result, new science techniques have been developed and existant techniques have been vastly improved and modified and these techniques being brought into the courtroom makes them all ‘forensic’.  The use of DNA profiling for the purpose of identification and paternity is a well-known and increasingly common example of this.  Once these sciences are brought to the courthouse with the intent to be presented as evidence in support of a party’s legal position, then judges and lawyers have to deal with this science.  Many times the science is complicated and difficult to grasp the internal mechanics of how it supposedly works and the experts who purport to be masters of this science don’t usually like to aid attorneys in their understanding, especially when they have been hired by an opposing party.  If you are involved in any kind of litigation that involves some kind of forensic science and you need help in understanding the science, its impact on your case, how the law affects the science and its admissibility into a courtroom, as well as how to deal with that evidence once it is being presented, call or email us at The Bax Law Firm. Our founding partner, Arie Bax, has over 13 years of experience in dealing with forensic evidence and has been recognized by his trial lawyer colleagues as a leader in forensic focused litigation.  Mr. Bax, as a result of his experience and performance and the reputation he has earned from that experience, has been brought into many Continuing Legal Education seminars as a speaker on the topic of Forensic Science and its impact on the law.  Mr. Bax is often called on by attorneys for advice and guidance on how to deal with forensic science and has helped many parties to effectively deal with forensic evidence issues, and he can help you.

Estate Planning, Wills & Trusts

Most of us want our loved ones to be taken care of should anything happen to us.  As much as we may not want to think of our own demise, most of us know that our families would appreciate being able to avoid the added stress of trying to figure out what you wanted to be done with your estate after you pass.  That is why planning for the future is so important.  Whether it is having a Power of Attorney (POA), drafting a will, or setting up a trust for your children and loved ones, this is a responsible way to take care of your family once you are no longer able to make decisions for yourself.

Estate planning will help take care of some of the details before that time comes.  Estate planning encompasses all that might of issue if you become incapacitated and no longer able to make decisions for yourself.  By engaging in estate planning, you can plan for such things as who will be responsible for medical decisions if and when you become unable to make them, what kind of end of life care you want to be considered, and who will handle your finances.  At The Bax Law Firm, we can aid you in the process of planning for the future and prepare all the necessary and valid documents and filings needed to secure that future.

Divorce Isn't Easy...

Everyone has either gone through a divorce or knows someone who has.  The same goes for custody battles.  These cases are hard.  They are emotional and they are trying to all parties involved.  Even parents with the best intentions can disagree on planning and dealing with the future of their children when they are no longer together.  Our attorneys have the experience and the compassion to help you through some of the lowest times you may experience as a spouse and/or parent.  We have been there through the child support hearings, the divorce proceedings and the Termination of Parental Rights actions.  Through it all, we stress to our clients that the Family Court is a court of equity and as such, the court has a tremendous amount of power when it comes to making decisions for all parties.  This plays a huge role in the reasons why anyone who tries to proceed through a Family Court case without an attorney does so at a large and often very costly disadvantage.  Our goal is to help our clients reach a resolution that not only puts the past behind them but also lets them move on in a productive way without losing access to the people and things you care the most about, whether it requires complete detachment from the opposing party or involvement in the co-parenting of a minor child.

We have taken on DSS and strived to hold them accountable when they become a part of our client’s families.  We have argued for the best interest of the minor children in custody and termination proceedings.  We have challenged the law when it is no longer equitable and our clients have suffered.  We have aided our clients in obtaining settlements that allow them to live separate and apart from their former spouses without having to lower their standard of living or claim bankruptcy.

After practicing this type of law for years, we will be the first to admit that family law cases are not easy and there is rarely a pain-free resolution waiting on the horizon.  However, having an experienced attorney at your side who is willing to fight for you can make all the difference when you come before the court.  We strive to give you the best legal advice and inform you of all available options and to present your case to the court in the best possible light that it can be.  Whether it is a name change for you or your minor child, or it is a request to modify custody, or an action for Separate Maintenance and Support, our attorneys are here to guide you.
